Professional Indemnity

Professional indemnity claims can be both complicated and sensitive. No matter the type or size of claim, our team is highly qualified and experienced to manage it.

Our team has:

  • expertly advised and represented thousands of senior professionals, as well as those in qualified trades
  • extensive experience in matters encompassing everything from small value disputes to multi-million dollar class actions

We have a large, national team with experts in all offices providing seamless coverage across Australia, and our expertise representing professionals in the construction, legal and financial industries is widely recognised.

Gilchrist Connell serves on panels for the solicitors’ professional indemnity schemes in NSW (Lawcover), SA (Law Claims) and WA (Law Mutual). These appointments as ‘lawyers’ lawyers’ in the majority of Australian jurisdictions reflect the recognised depth and calibre of our professional indemnity expertise.

As a market leader in legal services to the professional indemnity insurance market, many of our firm’s practitioners have been formally acknowledged by the industry. Our principals are consistently listed as front runners in professional indemnity claims in Australia in Doyle’s Guide.

Benefit from our expertise

We understand the sometimes confronting and arduous nature of a claim as well as the potential reputational and commercial concerns from the insured’s perspective, and we are adept at handling these matters with empathy and clarity.

We currently hold appointments on the panels of a large number of the major PI underwriters in the market including various Lloyd’s Syndicates.

Not all claims are amenable to settlement either at all or for a commercial figure, and we have run multiple high profile professional indemnity cases where we have acted for the professional, and pursued a defence to trial.

We are keenly aware that indemnity is paramount for both the insurer and the insured in PI claims, and treat this as a priority.

Our experience and understanding

We are experienced in managing the frequent tensions that arise in a PI setting between insurer, insured and broker – particularly with coverage and large deductable issues.

We understand that:

  • professional claims are generally complex and require mature and sensitive management of serious reputational issues for the insured
  • the way we manage a claim will directly impact on our client’s relationship with its insured
  • our clients require assurance that we will act at all times with integrity, honesty and empathy.

Streamlined approach to claims management

Our national, centralised and streamlined approach to efficient management of claims will produce quality, value and cost savings to our clients across all jurisdictions, with no compromise to claims outcomes.

Some matters require prompt settlement, others require a strong defence and we are equipped for all scenarios. We understand that a $25,000 claim against a conveyancer requires very different resources from a $60M multi-party construction negligence claim brought against an engineer – and in both of these actual matters, as well as in many others, Gilchrist Connell obtained excellent results.
