Gilchrist Connell has a highly experienced dedicated Workers Compensation group in South Australia and New South Wales. In addition to many routine claims, we have provided policy and strategic advice to the WorkCover Corporation in South Australia and represented it in numerous test cases in the Workers Compensation Tribunal, Supreme Court and High Court.
We have also acted for Comcare, the Commonwealth Workers Compensation insurer and licensed employers pursuant to the Commonwealth Scheme, as well as a number of exempt employers.
Our relevant experience in workers compensation law includes acting for an underwriter and a range of self insured entities in NSW and SA where we:
• advised on liability, entitlements, strategy and settlement;
• conducted conciliation conferences and arbitrations; and
• prepared and conducted judicial determination at first instance and on appeal.
Gilchrist Connell understands the industrial implications that can be associated with claims. We realise how important it is for the exempt employer to send a clear message to its workforce about workers compensation claims - that is, genuine claims will be fairly and expeditiously determined and unmeritorious claims strenuously resisted.
We are also well familiar with the risk of claims becoming protracted by unnecessary disputation and by becoming distracted from the main objective of employment resumption and productivity, as this will minimise the cost to the business.
We are also experienced in defending employers in prosecutions under occupational health, safety and welfare legislation and we’ve acted in many such matters.
